Welcome to Wienerwork. These Terms & Conditions ("Terms") govern your use of wienerwork.com (the "Site") and your purchase of products from us. The Site is operated by Random Ventures LLC ("Wienerwork," "we," "us"). By using the Site or placing an order, you agree to these Terms.
1.Eligibility
You must be at least 18 years old and located in the United States to place an order. We currently sell and ship only within the United States.
2.Our products
We create custom, made-to-order canvas portraits generated from a photograph you upload. Each product is personalized and produced specifically for you after purchase.
3.Your content and the license you grant us
You retain ownership of the photographs you upload. By uploading a photo, you grant Wienerwork a limited, non-exclusive license to use, reproduce, and modify that photo solely for the purpose of creating, producing, and delivering your order, and — only if you expressly opt in at checkout — to display the resulting artwork in our public gallery and marketing. You represent that you own or have permission to use any photo you upload, and that it does not infringe anyone's rights.
4.Acceptable use
You agree not to upload any image that is unlawful, infringes third-party rights, or depicts anything other than your pet. We may decline or cancel any order at our discretion.
5.Preview, orders, and pricing
You will see a preview of your portrait before payment. Prices are listed in US dollars and include standard US shipping. We reserve the right to correct errors and to change prices at any time before you order. Payment is processed by our third-party payment processor; we do not store your full payment card details.
6.All sales final
Because every item is custom-made and approved by you before printing, all sales are final. Our Return & Refund Policy (which addresses damaged or defective items) is incorporated into these Terms by reference.
7.Intellectual property
The Site, its design, and the artistic styles we offer are owned by Wienerwork and protected by applicable law. These Terms grant you no right to reproduce them except for your personal use of products you purchase.
8.Disclaimers
The Site and products are provided "as is" to the fullest extent permitted by law. Custom artwork is an interpretation of your photo; results vary by photo quality, which is why we show you a preview first.
9.Limitation of liability
To the fullest extent permitted by law, Wienerwork's total liability arising out of or relating to any order or these Terms shall not exceed the amount you paid for the order at issue. We are not liable for indirect, incidental, or consequential damages.
10.Indemnification
You agree to indemnify and hold Wienerwork harmless from claims arising out of your breach of these Terms or your misuse of the Site.
11.Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute shall be brought in the state or federal courts located in California.
12.Changes
We may update these Terms from time to time. The "Last updated" date reflects the most recent version.
